Re-CWP 19556/2021 – Panjab & Haryana High Court judgment
This is further to my submission dated 08.10.2021 demanding personal hearing but there is no response. I again request to please look into the matter and grant me an opportunity of personal hearing.
The Hon,ble High Court in its judgment dated 28.09.2021 directed the official respondents to consider the representations dated 14.11.2019,13.01.2020 & 06.06.2020 (Annexures P-2,P-3 and P-5, respectively) moved by the petitioner and decide the same in accordance with law, by passing a speaking order preferably within a period of one month from the date of receipt of the certified copy of this order.
In this respect I demand personal hearing in consonance to principle of natural justice.
Natural Justice is a great humanizing principle intended to vest law with fairness and to secure justice. Whether the power is quasi-judicial or administrative in character, in either case if the proposed action affects and individual adversely or it visits him with adverse evil consequences, the principles natural justice must be held to be applicable and implicit in the statue which is silent on whether or not opportunity should be given to the person affected.( Maneka Gandhi Vs Union of India, AIR 1978 SC597)
