Learned State counsel prays for still more time to file an additional
affidavit explaining the delay in the publication of a fresh voter list of the
members of the Saraswati Kunj Cooperative House Building Society (for short,
the Society). The needful be done at least three days before the adjourned date
with an advance copy to the learned counsel for the appellants.
Adjourned to 18.04.2024.
Since adequate time has already been granted, it is directed that in
case no affidavit, as above, is filed at least three days before the adjourned date,
the Deputy Commissioner, Gurugram-cum-Chairman of the Board of the
Administrators of the Society shall file an affidavit explaining therein the delay
in filing of the said affidavit.
With regard to the prayer made on behalf of the appellants for
staying the holding of elections to the Managing Committee of the Society, no
orders are required to be passed in the light of the statement made by learned
State counsel, on instructions from Mr.Vijender Singh Toney, Legal Consultant,
RCS Office, Haryana, Panchkula, that till the adjourned date the Board of
Administrators of the Society does not intend to even declare the holding of said
elections.
